These Terms of Use ("Terms") apply to the OptiPixel app for iPhone and iPad ("the App") developed by NightSoft ("we", "us", also referred to as "The Night Soft"). By downloading or using the App you agree to these Terms. If you do not agree, please do not use the App.
1. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on Apple devices that you own or control, as permitted by the App Store Terms of Service. These Terms add to Apple's Standard Licensed Application End User License Agreement ("Apple EULA"), which also applies.
2. OptiPixel Premium
The App is free to use with limits. OptiPixel Premium removes the limits and ads and unlocks every Pro tool.
- Plans: Premium is offered as an auto-renewing monthly or yearly subscription. Prices are shown in the App in your local currency before you buy.
- Free trial: when a free trial is offered (for example on the yearly plan), you are charged at the end of the trial unless you cancel at least 24 hours before it ends. Any unused part of a trial ends when you buy a subscription.
- Payment: payment is charged to your Apple Account when you confirm the purchase.
- Auto-renewal: a subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for the renewal within 24 hours before the period ends.
- Managing and cancelling: you can manage or cancel your subscription in your Apple Account settings (on iPhone: Settings › your name › Subscriptions). Deleting the App does not cancel a subscription.
- Refunds: refunds are handled by Apple under its policies; you can request one at reportaproblem.apple.com.
- Rewarded ads: in the free version you may watch a short ad to unlock a single larger task or a single Pro export. The unlock applies to that one task only.
3. Your content
- You keep all rights to the photos, videos, audio and other content you use with the App ("Your Content"). We do not receive Your Content and claim no rights in it.
- You are responsible for having the rights to the content you edit, watermark or share, and for making sure your use is lawful — including the privacy of people who appear in it.
- You agree not to use the App to create or share unlawful content, content that infringes someone else's rights, or content that exploits or harms minors.
4. AI features
AI Transform, Cutout, Remove Object, Face Blur and Text Extractor produce results automatically and may make mistakes. Check results before you rely on or share them. AI styles are artistic effects; they are not affiliated with, or endorsed by, any artist, studio or brand.
5. Backups
The App does not modify your originals unless you choose to replace a file in the Files app. You are still responsible for keeping backups of important media. We are not liable for data loss caused by device failure, iOS, or deletions you make.
6. Acceptable use
You may not copy, modify, reverse-engineer, resell or distribute the App, or try to bypass its purchase or ad systems, except as the law expressly allows.
7. Disclaimer
The App is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, including fitness for a particular purpose and uninterrupted or error-free operation.
8. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental or consequential damages, or for loss of data or profits, arising from your use of the App. Our total liability is limited to the amount you paid for the App or Premium in the 12 months before the claim. Nothing in these Terms limits rights you have under consumer law that cannot be excluded.
9. Changes and termination
We may update the App and these Terms. Continued use after a change means you accept the updated Terms. You can stop using the App at any time by deleting it; we may end your licence if you breach these Terms.
